The rules for using this website and buying a used machine through DHM Export: fees, the inspection, as is sales, delivery and export.
01Who you are dealing with
This website and the services described on it are run by EXL Business Consulting LLC, a Delaware limited liability company doing business as Dark Horse Machinery and DHM Export, based in Miami, Florida, United States. 02What we provide
- Searching for used heavy equipment in Florida that matches your request, from dealers, auctions, rental fleets, lenders and owners.
- Arranging an inspection of the machine you choose by an independent heavy equipment mechanic.
- Checking the title, the seller and the serial number, and negotiating price and terms on your behalf.
- Coordinating trucking to your yard or job site in Florida, or hand-off to your freight forwarder for export.
We work for the buyer and do not hold inventory. Machines are owned and sold by third parties until the purchase is completed. Sellers, mechanics, haulers and freight forwarders are independent companies; they are not parties to these terms, and their own terms may also apply.
03Fees and the inspection
- Our fee and the inspection fee are agreed with you in writing before the search starts or before the mechanic goes out. The inspection fee is quoted per machine, based on the machine type and location, and is paid up front.
- The inspection report describes the condition of the machine on the day it was inspected, based on what the mechanic could see, hear and test at that time. It is not a warranty or a guarantee of future performance.
- Prices and availability from sellers can change until a purchase is confirmed in writing. Listing prices, photos and descriptions come from the seller.
- You approve every number before we commit to anything on your behalf.
04Used machines are sold as is
Used machines are sold as is, where is, with no warranty, express or implied, including any warranty of merchantability or fitness for a particular purpose, unless the seller gives one in writing. What you get instead is an independent condition report before you pay. Repairs before delivery or shipping can be arranged at the buyer's cost.
05Delivery and export
- In Florida: trucking is quoted separately. You are responsible for safe, legal truck access at the delivery place and for having someone there to receive the machine.
- Export: the machine is handed to the freight forwarder you choose. From hand-off, ocean freight, insurance in transit, customs clearance, import duties, taxes and the import rules of the destination country are the buyer's responsibility, unless we agree otherwise in writing.
- Export rules: every sale must follow United States export control and sanctions laws. We do not sell or ship to anyone or any destination those laws prohibit, and we may ask for information about the buyer, the end user and the destination.
06Text messages
Text messages and WhatsApp messages from DHM Export are covered by our Text Messaging Terms. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Agreeing to receive texts is not a condition of any purchase.
07Using this website
Information on this website is general information and may change without notice. Prices, availability and fees are confirmed only in writing. Photos are for illustration and may not show the machine you buy. Brands named or shown on this website belong to their owners and do not imply endorsement. Do not use this website for anything unlawful or try to interfere with how it works.
08Limits on our responsibility
To the fullest extent the law allows, DHM Export is not responsible for indirect, incidental, special or consequential losses, including lost profits, downtime, delays or lost jobs, arising from use of this website or our services, or from the acts of sellers, mechanics, haulers or freight forwarders. Our total responsibility for any claim about a machine or a service is limited to the fees you paid us for that machine or service. Nothing in these terms limits responsibility that cannot legally be limited.
09Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. The courts of Miami-Dade County, Florida have jurisdiction.
10Changes to these terms
We may update these terms. The effective date at the top of this page shows when they last changed. If you keep using the website or our services after a change, you accept the updated terms. A written agreement for a specific machine takes priority over these terms where they differ.
